General conditions Midsummer Evening Walk
Article 1
The Midsummer Evening Walk (hereinafter referred to as: 'The Walking Tour') is an initiative of and is organized by Rotary Club Eindhoven-Zuid (hereinafter referred to as: 'the Organization').
Article 2
Registration is subject to the applicability of these general terms and conditions, as determined by the Organization.
Article 3
Participation in The Walking Tour is only possible for registered participants who have paid the registration fee of € 10 (€ 5,- up to and including 17 years).
Article 4
Each participant (hereinafter referred to as: 'Participant') in The Walking Tour, consisting of a sponsored walk of 30 km, 20 km, 15 km, 10 km or 5 km, will adhere to the rules as established by the Organization.
Article 5
Participation in the Walking Tour is only possible if the Participant has completed the registration form completely and truthfully and has therefore agreed to the general terms and conditions. By registering, the participant declares that he or she is familiar with the general terms and conditions.
Article 6
Registration as a Participant in the Walking Tour requires a minimum age of 18 years. If indicated in advance to the Organization, minors up to and including 17 years of age can walk under supervision the 10 km, 15 km or 20 km. For the 5 km walk, a minimum age of 6 years applies and adult supervision is also mandatory.
Article 7
Each Participant is aware, that the Walking Tour can be a test of their mental and physical strengths and that there is a risk of material damage or injury. Each Participant declares that ii is his or her own responsibility to determine whether his of her mental and physical condition is sufficient for participation in the Walking Tour.
Article 8
Each participant acknowledges the risks and aspects associated with participating in such an event. The Participant acknowledges that walking in the dark can be dangerous and declares to participate in the Walking Tour entirely at his or her own risk. There is no check by the Organization whether or not participants finish.
Article 9
Each Participant is responsible for his or her personal belongings and equipment during the Walking Tour.
Article 10
The Organization is at all times authorized to sanction violation of the terms and conditions or unsportsmanlike conduct, serious or improper conduct prior or during the Walking Tour, up to disqualification. During the Walking Tour the Organization is authorized to ask a Participant to withdraw if the Participant is not able or expected to finish the registered distance.
Article 11
The Organization has the right to cancel the Walking Tour, including but not limited to situations of force majeure, bad weather conditions or for safety reasons.
In the event of cancellation of The Walking Tour or in the event of cancellation by the Participant him or herself, a refund of the raised sponsorship money is not possible. The registration fee will be refunded by the Organization at the request of the Participant. If such a request is not made within 30 days after cancellation, the registration fee will count as a donation.
Article 12
The Organization reserves the right to change certain parts of the route, where necessary. The Participant is obliged to follow the route as indicated.
Article 13
For the safety of the Participants and due to the permits for the Walking Tour a maximum of 1100 participants is allowed. When the maximum number of registrations has been reached, the Organization reserves the right to select Participants who have raised sponsorship money. The Organization also reserves the right to exclude the Participants, who have raised 0 euros of sponsorship money. In case of exclusion, the registration fee will be refunded by the Organization at the request of the Participant. If such a request is not made within 14 days after exclusion, the registration fee will count as a donation.
Article 14
By using the opportunity to participate in the Walking Tour, the Participant hereby declares:
1 a) That he/she is aware of the risks that participation in the Walking Tour entails and that he/she participates at his/her own risk;
2 b) That he/she is in good (mental and physical) health and in sufficient physical condition to participate in the Walking Tour;
3 c) That he/she is not under the influence of alcohol of drugs during the Walking Tour;
4 d) That he/she waives any right of claim against the Organization, including its affiliated parties, persons or representatives, as a result of damages suffered during or as a consequence of the Walking Tour;
5 e) That he/she acknowledges that the Organization has the right, according to standards of fairness and reasonableness, to exclude him/her from participation (payments are non-refundable);
6 f) That he/she acknowledges that the Organization and all its representatives have the right to cancel the Walking Tour and that the Organization has no obligation to offer the possibility to have the Walking Tour take place or on another occasion if the Walking Tour does not take place in full;
7 g) To the extent that, despite the foregoing, there is any liability of the Organization, or its affiliated partners, persons or representatives, this liability is always limited to the amount refunded by the Organization’s liability insurance.
Article 15
These general terms and conditions also apply to companies or parties that register for the Walking Tour with a team (hereinafter referred to as “Participating Companies”). The Participating Company declares by registering that each individual Participant of the Participating Company has acknowledged and agrees to the content of the Terms and Conditions. The Participating Company indemnifies the Organization against liability for damage that third parties may suffer as a result of an act or omission attributable to a Participant with regard to the Walking Tour, as well as for damage that the Participant may suffer as a result of his/her participation in the Walking Tour, unless this damage is the direct result of intent or gross negligence attributable to the Organization. The Participant’s Participating Company declares to be adequately insured against the risk of liability for such damage.
Article 16
Each Participant gives permission to be photographed and/or filmed and will give full cooperation. The Participant consents to the use of his personal data, visual material, voice and biographical material in the context of media attention, publicity and other promotional and organizational activities initiated by the Organization. The Participant agrees that the Organization is the sole entity to decide whether or not to use visual material in which the Participant appears. All visual materials of the Walking Tour and the copyright remain the property of the Organization. Each Participant grants permission to the Organization to publish his/her name and competition results, for example by means of publication in newspapers and via the Internet.
Article 17
In all cases not provided for in the General Terms and Conditions of the Walking Tour, the Organization decides.
The donated sponsorship amount is intended for the indicated cancer-related causes, minus the external costs. The Organization consists entirely of volunteers, any additional costs can be deducted from the sponsorship amount.
Article 18
The legal relationship between the Organization and the Participant and/or the Participating Company is governed by Dutch law. All possible disputes arising from or related to the aforementioned legal relationship will be submitted exclusively to the authorized judge of the District Court of Oost-Brabant.
